Florida-Specific Hemp & Cannabinoid Laws

Florida legalized hemp and its derivatives—including THCA, Delta-8 THC, Delta-9 THC (hemp-derived), and HHC—under the Florida Hemp Program, which aligns with the federal standards of the 2018 Farm Bill. However, the state has introduced additional rules to regulate the safety, marketing, and packaging of hemp products.

  • Hemp-derived cannabinoids are legal in Florida as long as they contain less than 0.3% Delta-9 THC by dry weight.

  • Florida does not currently ban isomers such as Delta-8 THC, but strict rules apply to their production, labeling, and sale.
  • Florida Department of Agriculture and Consumer Services (FDACS) Oversight:

The FDACS enforces strict guidelines under Rule 5K-4.034, which includes:

  • Prohibiting packaging or branding that appeals to children (e.g., cartoons or bright candy-like graphics).
  • Mandatory labeling that includes batch numbers, QR codes linked to Certificates of Analysis (COAs), ingredient disclosure, and proper cannabinoid content.
  • Child-resistant packaging requirements for all inhalable or edible products.
  • Banned color additives that are not FDA-approved.
  • Prohibition of health or medical claims unless approved by the FDA.
